This Privacy Policy provides additional information to California, Nebraska, and Texas consumers (defined under applicable Privacy Law in the jurisdiction) whose Personal Data is collected pursuant to the California Consumer Privacy Act (“CCPA”)(as amended by the California Privacy Rights Act), Nebraska Data Privacy Act (“NDPA”), or Texas Data Privacy and Security Act (TDPSA”) (generically referred to as “Privacy Laws”). The following rights do not all apply under each of the Privacy Laws. The following provides certain specific notices to you as required under the applicable Privacy Laws and explains the rights you may have under the applicable Privacy Laws, depending on where you reside and the jurisdiction that Victory is subject to related to your Personal Data. This section applies solely to California, Texas and Nebraska consumers.

Your Rights Under Applicable Privacy Laws. Depending upon your jurisdiction and applicable law, you may have the following rights with respect to your Personal Data:

1. Right to Access and Know. As more particularly described in the applicable Privacy Law in your jurisdiction, and subject to certain exceptions, you may request that we disclose the following information:

Under the applicable Privacy Laws, the right to obtain “specific pieces” does not grant a right to the whole of any document that contains Personal Data, but only the right to obtain items of your Personal Data. Additionally, you have a right to know “categories” of sources of Personal Data and “categories” of third parties to which Personal Data is disclosed, but not the individual sources or third parties. Victory does not always track individualized sources or recipients.

However, based on our understanding of the CCPA at this time, we do not, and in the preceding 12 months we did not, sell or share (each as used under the CCPA) any Personal Data of California consumers to any third parties, and we are not required to honor any opt-out preference signals. As such, we also do not have actual knowledge of our selling or sharing (each as used under the CCPA) Personal Data belonging to California consumers under 16 years of age. The CCPA generally defines “sharing” as the disclosure of Personal Data for cross-context behavioral advertising.

6. Right to Limit Use or Disclosure of Sensitive Personal Data (For California Consumers Only). As more particularly described in the CCPA, and subject to certain exceptions, if a business uses or discloses California consumers’ sensitive personal information (as defined in the CCPA) for reasons other than those exempted by the CCPA, California consumers have the right to limit the use or disclosure of their sensitive personal information by the business. However, we do not, and in the preceding 12 months we did not, use or disclose California consumers’ sensitive personal information for purposes other than those specified in Cal. 7. Right to Opt-Out of Processing of Personal Data for Targeted Advertising, Sale of Personal Data or Profiling (For Texas and Nebraska Consumers Only). As more particularly described in the applicable law in your jurisdiction, and subject to certain exceptions, you have the right to opt out of the processing of your Personal Data for purposes of targeted advertising, the sale of Personal Data, or profiling in furtherance of a decision that produces a legal or similarly significant effect concerning the consumer. However, based on our understanding of the TDPSA and NDPA at this time, we do not engage in the processing of Personal Data of Texas or Nebraska consumers for purposes of targeted advertising, the sale of Personal Data (including the sale of sensitive data or biometric data), or profiling in furtherance of a decision that produces a legal or similarly significant effect concerning consumers (as each of these terms are respectively defined and further described under the TDPSA and NDPA).

The response we provide will also explain the reasons we cannot comply with a request, if applicable. For requests to access/know, we will select a format to provide your Personal Data that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

For data portability requests, we will select a format to provide your Personal Data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

A record concerning the requests may be maintained pursuant to our legal obligations. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.
